All orders that you place on the our website will be subject to acceptance in accordance with these terms and conditions. Your order becomes binding once we have accepted it. It is your responsibility to check that all details of your order, such as specifications, measurements, product features, and delivery information, are correct and suitable to your requirements prior to placing your order.
We reserve the right to withdraw any products from our website at any time and/or remove or edit any materials or content. We may suspend or refuse to process a transaction for any reason or refuse service to anyone at any time at
our sole discretion.
To be eligible to purchase Products on this website and lawfully enter into and form contracts on this website under English law you must: be over 18 years of age; register by providing your real name, phone number, email address, payment details and other requested information; provide a valid delivery address and telephone number (Please note that PO box numbers, hotels and temporary accommodation addresses are not acceptable); and possess a valid credit or debit card issued by a bank acceptable to us.
Intellectual property:
You recognise and agree that all copyright, database rights, trademarks and all other intellectual property rights in all material and/or content of this website is owned by Carpet Bags and shall remain at all times vested in us as expressly authorized by us.
Payment:
Prices include VAT and exclude delivery charges unless otherwise stated.
All prices are correct at time of entering but may change due to inadvertent administrative errors or circumstances beyond our control, such as any variations to the rate of VAT.
When payment is by credit card, for goods ordered via the ordering
system on this website, your credit card account will be debited
with the total sum due
in Pounds Sterling. Currency conversion rates on overseas order transactions
are determined by the Credit/Debit Card companies who use the business rate of exchange at the time the card transaction is processed by them.
Your card account will be debited by our secure server on notification of receipt of order and is out of our control.
For orders telephoned or emailed to us with your Credit Card details
the same method as above will be used at the time of despatch rather than the time of order.
For orders mailed to us, please enclose your cheque in Pounds Sterling
drawn on a UK bank for the total amount due, or your credit card
details, including, card number, commencement and expiry dates,
3 digit security code (last 3 digits found on the back of your card on the signature
strip), name, address and daytime telephone number. (When using your
Maestro card (UK) please remember to include the issue number or valid from date). Goods will
only be despatched upon our receipt of cleared funds.
Purchases:
Please note: Fabric patterns, colours and sizes may vary slightly due to the individual and handmade nature of our unique bags.
Although we aim to despatch orders as soon as they are received, some items may be in production and therefore take a little longer and you are advised that sometimes this can be up to 28 days (although rare) for delivery in the UK and Europe and up to 48 days for delivery to the rest of the world.
There is a message section at checkout for personal messages to the recipient of an order but this may also be used to inform us of a required delivery date for a birthday or other special occasion or delivery instructions.
There will be an automatic email confirmation upon our receipt of an order but no others will follow as we are a small business, if you wish to know the progress of an order then please do email or telephone.
Non-receipt of goods should be advised to us by e-mail or telephone, within 28 days of notified receipt of order date.
Returns:
All goods purchased will only be exchanged, or credited, if returned, in as new condition within 14 days of the despatch/invoice date.
If your goods arrive in a damaged condition you should immediately notify the carrier and advise us within 7 days of the receipt of the goods.
Please note that when returning goods the carriage and insurance are the liability of the buyer.
Please ensure that we are advised prior to your returning any items.
All goods should be packed appropriately and insured against loss or damage.
No refunds, credit notes or exchanges can be made, where goods do
not reach us, or are returned in an unacceptable condition.
Please ensure that the package is clearly marked with your name and
address and that the original Receipt/Invoice is enclosed.
Refunds are made for the price of the goods, but shipping charges are not refundable.
International:
All Products are sold on Delivery Duty Unpaid basis. Recipients outside the EU may have to pay import duty or a formal customs entry fee prior to or on delivery and additional taxes, fees or levies may apply according to local legislation. Please check these details before placing any orders for deliveries outside the EU.
If you are paying with an international credit or bank payment card, you may be subject to an additional administration/handling fee and/or any other charges that may apply by the Credit Card Company or bank who will also determine the currency conversion rate applicable at the time of the transaction.
www.carpetbags.co.uk is a UK website. We only accept Pounds Sterling (£) on all transactions made.
Carpet Bags will no longer be able to process VAT refunds for international customers. This amount covers the increased carriage charges that have occurred for international orders.
Indemnity:
You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your
Personal Information.
We shall not be liable for any economic losses (including without limitation loss of profits, revenue, business, contracts, management time, data or anticipated savings) nor for any loss of goodwill or reputation nor for any indirect loss whether arising in contract or tort (including negligence) or pre-contractual or other representations (except for fraudulent or negligent misrepresentation) or otherwise even if advised of the probability of such damage or where it was foreseeable. In no event shall our liability under these terms and conditions exceed the amount paid or payable by you for the products or goods. This does not affect your statutory rights as a consumer, nor does it affect your rights of cancellation.
We shall take all reasonable precautions to keep the details of your order and payment secure, except where we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
Data Protection and Privacy:
In addition to allowing us to check your creditworthiness and process your orders, the personal data you submit, and our records of your visits to the Site, will be used to monitor and improve our service to you, and for marketing purposes. We may send you, brochures, leaflets and catalogues displaying our products and services, and may telephone you in order to tell you of promotional offers, to discuss account details or for market research.
We will respect the privacy of your personal data, and will comply with all relevant and current data protection legislation. We will not disclose your personal data to anyone, unless required to do so by a court of competent jurisdiction.
If you wish to update or delete your personal information, or if you prefer that we do not email you to tell you of promotional offers, please contact us.
To proceed with your order, we have to process and store your data, and provide your data to third parties who are directly involved with your order, e.g. our carriers. By placing an order with us, you agree to your data being processed by Carpet bags. Guarantee:
All of our products carry a three month guarantee against defects in
manufacture. In the unlikely event of this occurring please advise us immediately
by e-mail or telephone, and return the goods for credit or replacement.
In this event all carriage and insurance costs will be refunded to
you upon presentation of your carriers receipt.
